Welcome to CuddleDiary ("we," "us," or "our"). These Terms of Service ("Terms") govern your download, installation, access to, and use of the CuddleDiary mobile application for iOS, website (cuddlediary.com), and related services (collectively, the "Service").
By creating an account, tapping "Continue," "Sign In," or "Create Account," downloading the app, or accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. All insights, wake window predictions, feeding summaries, growth charts (including WHO growth percentiles), and age-based suggestions generated by the app are automated calculations based on user input. They are not medical assessments.
Always seek the advice of your pediatrician or qualified health provider with any questions you may have regarding your baby's health, symptoms, feeding routine, growth rate, or sleep schedules. Never disregard professional medical advice or delay seeking medical attention because of information viewed in CuddleDiary. In case of a medical emergency, immediately contact your local emergency services or healthcare provider.
To use CuddleDiary, you must create an account using a valid email address or supported single sign-on providers (such as Sign in with Apple or Google Sign-In). You agree to:
You are solely responsible for all activities, logs, and modifications that occur under your account.
CuddleDiary allows profile owners ("Owners") to generate invite codes to share access to a baby's profile with other users ("Caregivers," such as co-parents, grandparents, or nannies).
CuddleDiary offers optional auto-renewable subscriptions ("CuddleDiary Premium") that unlock advanced features such as sleep window predictions, unlimited historical data, PDF report generation, and multi-caregiver sync.

Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that publication, where applicable.
You can manage or cancel your auto-renewable subscription at any time by going to your iOS device settings:

Turn off auto-renewal at least 24 hours before your billing cycle ends to avoid being charged for the next period.
All subscription purchases, billing, and refunds are managed exclusively by Apple Inc. in accordance with Apple's Terms & Conditions. We do not directly handle refunds or billing details. To request a refund, please visit reportaproblem.apple.com.
You retain full ownership of all data, text, photos, growth logs, and notes you enter into CuddleDiary ("User Content").
By uploading or entering User Content, you grant CuddleDiary a worldwide, non-exclusive, royalty-free license to store, transmit, process, and display your User Content solely for the purpose of operating, maintaining, and providing the Service to you and your authorized caregivers. We do not sell your User Content to third parties or advertisers.
You represent and warrant that you own or have all necessary rights to upload your User Content, and that your User Content does not violate any third-party rights or applicable laws.
You agree not to use CuddleDiary to:
The Service, including the CuddleDiary name, logo, UI/UX designs, icons, graphics, algorithms, brand themes, software code, and documentation, is owned by CuddleDiary and protected by copyright, trademark, and intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the CuddleDiary iOS application on your personal Apple devices solely for your personal, non-commercial use.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, CUDDLEDIARY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT TRACKING DATA OR PREDICTIONS WILL BE 100% ACCURATE OR TIMELY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CUDDLEDIARY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNATIVE DAMAGES (INCLUDING LOSS OF DATA, LOSS OF GOODWILL, OR SERVICE INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS OR FROM THE USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO CUDDLEDIARY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless CuddleDiary and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms, your User Content, or your unauthorized use of the Service.
You may terminate these Terms at any time by deleting your CuddleDiary account using the in-app account deletion setting (Settings > Delete Account) and uninstalling the app from your device.
We reserve the right to suspend or terminate your account or access to the Service at any time, with or without cause or notice, if we believe you have breached these Terms or engaged in fraudulent or harmful activity.
Upon account deletion, your personal account details, profile links, and associated baby logs will be permanently deleted from our primary database in accordance with our Privacy Policy.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and notify users via in-app notification or email. Your continued use of CuddleDiary following the posting of revised Terms constitutes your acceptance of the changes.
